Notice of California Check Cashing Class Action Settlement
THIS NOTICE MAY AFFECT YOUR RIGHTS. PLEASE READ IT CAREFULLY.
  • A Settlement has been proposed in a class action lawsuit against California Check Cashing Stores, LLC and/or CheckSmart Financial, LLC, relating to an alleged violation of the FCRA and California law by procuring a background check report with the use of a non-compliant disclosure form.

  • You are included in this Settlement as a “Class Member” if you are one of the persons who were the subject of a background report (including a consumer report and/or investigative consumer report) obtained by Defendants’ California Check Cashing Stores, LLC and/or CheckSmart Financial, LLC from and including July 20, 2010, through December 31, 2016, in connection with an application for employment.

  • Under the Settlement, California Check Cashing Stores, LLC has agreed to establish a fund of $1,500,000.00, from which payments will be made for: (a) attorneys’ fees, expenses and costs incurred by Class Counsel, subject to Court approval; (b) the Class Representative Service Award in an amount approved by the Court; (c) any Court-approved costs for Notice and settlement administration by a third-party administrator selected by agreement of the Parties and approved by the Court; and (d) all payments to Participating Settlement Class Members.

  • Your legal rights will be affected whether you act or do not act.

YOUR LEGAL RIGHTS AND OPTIONS IN THIS SETTLEMENT
INCLUDE THE FOLLOWING:

DO NOTHING

You will receive a payment from the Settlement, and you will release certain claims covered by the Settlement against Defendants.

EXCLUDE YOURSELF

If you decide to opt out from this settlement, please complete the Opt Out form no later than June 12, 2023. Please note that you will not be eligible for a cash payment, and you may retain any and all rights you may have against the Defendants.

OBJECT

Write to the Court about why you do not agree with the Settlement. The Court may or may not agree with your objection. Objecting to the Settlement will not exclude you from the Settlement. Note: You may also make an objection by appearing at the Final Approval Hearing.

GO TO A HEARING

Ask to speak in Court about the fairness of the Settlement.

These rights and options—and the deadlines to exercise them—are explained in the Notice.

The Court in charge of this case still must decide whether to approve the Settlement. No Settlement benefits or payments will be provided unless the Court approves the Settlement, and it becomes final. Please be patient.
